Chow Foods' Dow Chow Contest Rules & Regulations 2009

OFFICIAL RULES
  1. PROGRAM DESCRIPTION: Chow's Dow Chow Event ("Event") begins at 5:00:01 p.m. PDT October 1, 2009, and ends at 11:00:01 p.m. PDT October 28, 2009.
  2. HOW TO ENTER: NO PURCHASE NECESSARY. Making a purchase will not increase the chance of winning. Entrants are to visit any of the four Chow restaurants—5 Spot, Atlas Foods, Endolyne Joe's and the Hi-Life—to obtain a pre-printed entry envelope. Restaurant addresses and contact information can be found at www.chowfoods.com. Each envelope allows up to three (3) guesses. Entrants are to print legibly up to three (3) guesses per envelope as to what they predict the Dow Jones Industrial Average will close at on the end of trading Thursday, October 29, 2009. Guesses are to be predicted down to two decimal points, for example 9655.23 or 8965.72. Entrants must print legibly their full name (first and last name), email address and phone number. A donation of $1 per guess is suggested; 100% of proceeds from Chow's contest will be contributed to Arts Corps, a nonprofit organization located in Seattle, Washington. More information on this organization can be found at artscorps.org. No facsimile entries will be accepted.
    Chow limits the guesses per person to twenty-one (21). This does not mean 21 guesses per restaurant, but 21 guesses overall. Should any entrant submit more than 21 guesses, the judging panel will find the average guess made by the entrant and include the ten guesses that are above the average guess by that entrant and the ten guesses that are below the average guess by the entrant. The balance of the guesses will be discarded and not considered for the contest.
    Chow assumes no responsibility for entries that are lost, late, misdirected, incorrect illegible or incomplete for any reason or for any computer or human error or technical malfunctions that may occur. All entries become the property of Chow and will not be acknowledged or returned.
  3. WINNER SELECTION: The winning entrant will be the individual who guesses the exact close of the Dow Jones Industrial Average (symbol: DJIA) to two (2) decimal points at the accepted and published close of the stock market at 16:30 EDT on October 29, 2009. The determining source of the closing figure will be found at www.djindexes.com under the listing of Dow Jones UBS Commodity Indexes.
    Should there be more than one entrant that guesses the exact close of the Dow, there will be a drawing held by Chow Foods representatives between the entrants that guessed the exact close no later than 5 p.m. PDT, October 30, 2009, to determine the winner of the contest. Should no contestant guess the exact close of the Dow Jones Industrial Average to the two decimal-point figure, the person who guesses the closest to the closing average, but not above or higher than the close of the Dow, will be the winning entry. Should there be more than one entrant who guesses a like amount, but not at or higher than the actual closing average, a drawing between those entrants will be held by Chow Foods representatives no later than 5 p.m. PDT, October 30, 2009, to determine the winner of the contest. Example: If the Dow closes at 9750.53 at 16:30 ET on October 29, 2009. Entrant #1 guesses 9750.33 and Entrant #2 guesses 9750.55. Entrant #1 is .20 basis points below the correct close and Entrant #2 is .02 basis point above the correct close. Even though Entrant #2 is closer, Entrant #1 wins the prize because his or her guess did not exceed the actual closing average of the Dow. Odds of winning depend on entrant's skill in guessing the exact close of the Dow Jones Industrial Average and in the event of a tie, the number of correct or equally close guesses.
    The winning entry must include both a valid email address and a current phone number to ensure the ability to contact the winning entrant. Any entry without both of these forms of contact will be eliminated from the contest. The winner will be notified by email and/or telephone. If the winner is unreachable after five (5) business days, or if a winner is unavailable for prize fulfillment, an alternate winner of the next closest guess may be selected from all remaining eligible entries received. The declared winner must personally present his or herself by appointment to the Chow Foods offices at 2114 North 45th Street, Seattle, Washington, 98103 to claim the prize. Two forms of legal, verifiable identification must be presented to Chow's representatives to claim the prize.
  4. PRIZE: There is one (1) grand prize only. The declared winner will receive food and beverage purchase credits at Chow Foods restaurants in the form of multiple Chow Foods gift cards in increments of $500.00 each. Any partial amount required as a result of the incremental close of the DOW will be issued in an exact amount. There will be no exception to this form of distribution. The total value of the grand prize will be the dollar equivalent of the Dow Jones Industrial Average close on October 29, 2009. Example: If the Dow Jones Industrial Average closes at 9355.67, the value of the prize will be $9,355.67; the winner would be issued eighteen (18) $500.00 gift cards and one (1) gift card in the amount of $355.67.
    The declared winner will be able to utilize the Chow Food Gift Cards at any Chow Foods restaurants. There will however be a limit per use in an amount not to exceed $500.00 per each visit to a restaurant. Example: the winner visits a Chow Food restaurant with a large party for dinner; the final bill for the meal is $650.00. The winner may only use one $500.00 gift card for this visit and the balance of $150.00 must be paid in cash. Without exception, Chow will not reissue any gift card(s) in any amount if one or multiple gift cards are reported lost or stolen by the winner at any time subsequent to the prize being issued. This prize is not redeemable for cash, trade, or sale, nor is it transferable.
  5. WINNER PUBLICITY: Chow reserves the right to use the winner's names in its publicity and promotions. The winner may be required to sign an affidavit of eligibility and liability/publicity release.   6. GENERAL CONDITIONS: Entrants must be legal residents of one of the fifty United States or the District of Columbia, and must be 18 years old or older to enter. Residents of New York, Rhode Island and Florida are not eligible to enter. Void outside the fifty United States and where prohibited by law. Anyone employed by Chow Foods or its advertising or promotion agencies at any time between October 1, 2009 and October 28, 2009 and any employees' immediate family members are not eligible to enter. Employees of Arts Corps, members of its Board of Directors, and their immediate family members are not eligible to enter.
    Entrants agree to be bound by the terms of these official rules. All federal, state and local laws and regulations apply. By entering, participants release and hold harmless Chow Foods, its partners, and each of their directors, officers, employees, independent contractors, representatives, agents, or advertising and promotion agencies (collectively, "promoters") from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this or acceptance or use of any prize won. Entrants agree that the laws of the state of Washington will govern any and all disputes. Promoters are not responsible for printing or typographical errors in any Contest-related materials. Prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made. All income and other taxes, fees and surcharges on prizes are the sole responsibility of winner. No substitution, transfer, or cash equivalent of prizes by winner. Chow reserves the right, at its discretion, to substitute a prize (or portion thereof) of equal or greater value.
